It's an FDA regulation, Title 21, Code of Federal Regulations, Part 1240.62, which means it's a federal regulation and applies to all states, making it illegal to sell a turtle under 4" in connection with a business unless for BONA FIDE scientific, educational, or exhibitional purposes, other than use as pets.

A hobbyist trading or giving away hatchlings is OK, and it seems as if selling a limited number of hatchlings would be OK, if NOT in connection with a business.

You wouldn't mind posting the address of that store, would you? Street address and city?

Sliders get pretty big, between 6-12 inches depending on the gender. Do you think most people who buy them for $3 are up for this?
