4" and above.

Chinatown gets away with $#! with selling under 4" babies...

It's a federal regulation, so it holds true in all states.

Turtles and tortoises are supposed to be at least 4" long straight length across the carapace before being sold.

Now, in most areas it's perfectly fine to give away chelonians under 4".
