And more importantly if I were to make shirts, hats, ect would I be sued? I figure Bens got his West Coast knockoffs, and Reptile Depot has the "Home Depot" knockoff, so why not join the club...LOL

Funny thing is it was a TON of work to do this knockoff from scratch. I couldnt get the font exactly like the "brands" font, but got pretty close I think. I still have to work with it a bit, the highlights are a real pain in the @@@ to make to say the least.

Tell you the truth I see nothing wrong with that one. It has the colors, but I do not believe color is a patent infringement. Andy

I'm not sure a logo focusing on eating your lizards is really that appetizing.

As far as any kind of logo infringement, I was in magazine publishing for 25 years and what was usually done is a "cease and desist" letter would be sent by the company's lawyers. If this didn't scare you away, then a suit would be filed. Just fighting it costs more money that it's worth, unless of course you're really set on using your design.

In any case, it was fun to see.

Like you said the first round is usually a cease and desist letter.

I wouldn't base my company logo on another logo just in case that letter came in. You'd lose all the branding and logo recognition you've built to market your company. This can cost much more in lost sales than the cost of the business cards, lawyers etc.

Now, as a spoof, promotion type deal I could see doing it. For example getting some shirts made up just to have fun and use in a one time promotion. Since your not a fortune 500 company and in a different industry than "that other company" I doubt they would go after you for a one time promotion type of deal.

I used to work with an advertising company so I’ve been down this road before.

To use it another companies logo or “reasonable representation of “ as your own logo can run you into problems.

The company who owns the rights to the logo can approach you with a cease and desist suit because:

1: You used the work king
2: The shape of the logos are similar
3: The colours are close enough on the pantone scale to be considered a duplication
4: The fonts are similar enough and in similar sizing raitos
5: The highlighting on the “buns” is nearly identical

It’s unlikely that you would ever be approached by the legal departments of investment firm Texas Pacific Group, Bain Capital and Goldman Sachs Capital Partners who own Burger King and all associated trade marks and logos but if they think:

1: You company benefits unduly by association
2: Your company is of high profile in its market place
3: The nature or behaviour of your company will bring theirs into disrepute
4: They were in a bad mood when they heard about it…

They will by all means approach your company to:

1: Stop using their logo
2: Destroy all merchandise, letterhead, business cards or company material with the logo
3: Remove it from any online areas
4: THE BIG ONE: Pay reimbursement to the company for legal costs, harm to reputation or operations, perceived financial loss, a loss of customer/shareholders confidence.

Their lawyers are usually on staff anyway and the company will sue you because there is no actual out of pocket for legal expenses. For you though the cost and time involved can be a real bother.

So because of the time and expense for designing your company’s logo its usually best to do one that isn’t so boarder line. Knock off logos are usually only used in short term, low risk promotions where they are used and discarded before the trademark holder gets up in arms.

To use a knock off logo as a main company logo usually doesn’t fly well with consumers, it doesn’t instil trust and confidence….often in study groups they often believe the company could be a little sketchy.

Just my been there done that 2 cents

Well I wasnt planning on useing it as my main "logo" if I imlied that I did not mean to.

Im thinking just quick promotional knockoffs for a trade shows, ect. Not on business cards, the web page, ect.

Glad I did a good enough job that everyone could tell what I was shooting for.

Could make the buns look a little like lizzard iris' so that way it is not burger buns but lizzard eyes.
Funny too., I had Noah try and sue me for Boa's Ark but when I drew the snake wrappining around the ark, God told him to lay off my case.

How many calls stem from your trailer? I'm sure you don't have an exact number, but do you hear the trailer being how they heard of you often, or hardly at all? Just curious, thanks.

every day for my other job(Interior cartpenter) I would see all the faces light up when they read the trailer and then the pull upside the truck and ask "do you have snakes in that trailer", I would reply with a yes a 45 footer and then really freak them out.
But to answer the questions regarding the phone calls, I would get at least 1 a week or 2-3 per month, depending how far I had to travel, I have had several birthday partys from it and several well paid school shows, and when I would do the local sale shows , I would park it right out front for everyone to see it, it is hard to miss.People would even tell me they have seen me driviing down the road.Kids love it they all think I keep the reptiles in there.
It has really paid its self off in just one years worth of shows and partys, not bad for a $1,300. trailer.
