Well a little geographic help would be good info on id'ing this snake. If it was taken here in the states, I would have to say it is an earthsnake, Virginia valeriae. It looks to have been hurt on the neck/upper back area, maybe this is why it is displaying the open mouth. I have caught one or two that displayed the open mouth threat and even bit. Not venomous and totally harmless. They eat earthworms, slugs, other small baby snakes/lizards, and soft bodied insects.

It's a shot taken near a cave, in the SE.
The photographer and friends would NEVER harm a snake, so I don't know what caused any injury to it.
Cavers occasinally rescue snakes that fall into vertical caves (pits). But I am pretty sure this was just a shot in situ.
If it was found in the SE then its a rough earth snake.
I wasnt implying that anyone hurt the snake, just an observation of its neck area. It is flattened and damaged looking, so this is probably why it is posturing open mouthed, to look meaner than it really is.
Alot of animals prey on these snakes, including fox, coyote, turkey, hawks, eagles, feral hogs, feral cats, and the list goes on....
