So I took the advice of some of the people on this board reguarding an eastern fox. I took it to the DNR so they could release it, well I misidentified the animal. It is a western fox, which apparently looks almost identicle to an eastern. The DNR officer said it's fine to keep the animal, and also informed me that I shouldn't make it a habit to keep wild caught snakes.
