Permit Questions?

wlamore Jan 03, 2006 04:05 PM

Victoria and Gloria are covered up today comming back from the holidays. Can any one tell me with regard to Interstate Permit:

1. if a party in another state is willing to donate or gift an eastern indigo to a party in another state, without any interstate commerce being involved, does one need to have the permit to ship it? With Class 1 Endangered Species and lower you do not as long as you have a signed letter in the box stating it is a gift or donation. One can ship without any permits as long as no money, trades or barter is involved.

2. if you want to purchase easterns from more than one breeder, can you submit the "Breeding Statements" covering their animals at the same time under 1 permit for the $100 or do you have to get a separate permit for each breeder.

Thanks, I'm sure someone here will know.

I don't know about part one of your question but as far as part 2. You can attach several breeders statements to one application. and all transactions must be completed during the set time frame which was 6 months when I did it last summer. The permit took 94 days to get approved in my case. At least it took 94 days from sending in the application package and my reciving an approved permit. Hope this is helpful.

Are you asking or telling? So you don't need a permit with a "gift exchange"?

No, I am asking, does anyone know if the same regulation for gifting specimens applies to Native Threatned species such as the eastern indigo. I know this is true for species and sub-species not found in the U.S. that are covered under the Endangered Species Act. The people that issued my CBW permit for captive reproduction of Python.m.molurus verified it. I have never sold or purchased molurus, just had them donated to me or given them to interested python keepers. I have not been able to verify it with the people that issue the permits in Atlanta due to the Holidays, so I thought maybe someone on this forum might verify it, if they have given or donated any hatchlings to interested parties or institutions.

Sorry for the confussion.

do not require interstate commerce permits. However, should any form of barter or monetary transaction take place, you will be required to acquire interstate commerce permits for out of state transactions.
Yes, you may amend multiple breeders to a single permit application. You may even amend your permit, so long as the time period it covers has not elapsed, to acquire specimens from a different, or same breeder, should you decide to acquire more after the initial permit has been applied for, though there is a $50.00US fee for such..

Hope this helps,

Jeff

Thanks for the information. Gloria from the Wildlife division called me back this morning and confirmed just what you said. Bonafide gift require no permits and one can submit more than one breeding statement from breeders if you are buying several from more than one source. Sounds fair to me.

Thanks for the Input

Good news, Bill,

I'm glad to hear Victoria was able to get back to you in such short order, as I know she is buried with work right now..

Best regards,

Jeff
