for what species?
ok, i see quite alot of refferences in these forums about 40 gallon breeder tanks, problem is, with being in the uk, our gallons are different to yours. can somone please give the average size of a 40gall breeder in inchs please? just so i know what size im looking at

36" long, 18" wide, and 18" tall.
a 40 gallon tank is not a good size for housing an adult RES. Its too small.

Yes your turtle is too big for a tank that small. I plan to buy a 40 gallon breeder in the near future. It's going to house a mud turtle who is less than 5 inches long, that's as big as he'll ever be. I know for certain that he'll be 10 years old this spring. As tiny as he is the tank is going to be huge for him.
After Christmas I put my 12 year old western painted male who's about 5 inches long in a brand new 55 gallon. It's great for him, he's full grown. I can't imagine a turtle that much larger than him in the 55, even 55 gallons is too small for a 9 inch turtle who will probably grow to 12 inches eventually.
You need a 100 gallon or larger tank for a full grown female RES.
