I shipped fedex overnight priority. box was lost, customer did not notify me until the next day. My question is who is liable , me or the customer.

Guaranteeing live arrival is up to you and your policy. FedEx and UPS don't guarantee live arrival, that is your own personal guarantee, or not.

If the package is misrouted, or has mechanical or weather delays, or is lost, I guarantee not just the shipping cost, but animal cost as well. It happens very rarely, but it does happen. To me, it is the cost of doing business. I would rather take care of that rare circumstance rather than leave that customer hanging, and with a bad experience they will certainly share with others.

I would rather obsorb the loss and have them share a great experience.

If you didn't have a policy in place beforehand, then it is up to you to read and react. Have a policy in place for the future though.

Best of luck.
