Sorry to be so late in answering this. You've probably gotten your answer by now but just in case....
Yes, you can spay while she's in heat. All 3 of my females were in heat when they were spayed.
Females will usually cycle in and out of heat until they get spayed, get pregnant or cold winter sets in. Then it begins all over again the next warm season.

As long as the cat is well looked after I doubt if she could be taken back. Your vet is correct, she should not be speyed until 2 weeks after going off heat. It will be easier in cool weather as she will not come on heat so readily. Just don't let her out until speyed
