No, the breeder cannot be legally held liable. We are breeders in NY state which has extremily strict lemon laws on pets and even here if it isn't a life threatening condition, they aren't liable. Also, usually (depending on the contract you signed) those legal protections are only good if you take the animal to the vet within 72 hours of obtaining it and get a letter from the vet saying the animal is unsound. Having said that, yes it may be the breeder's FAULT (bad genetics possibly), but that doesn't make them liable. Anyway, the best you could hope for would be for the breeder to take back and replace your kittens, you can't get your money back, generally and the new kittens might have the same trouble. Even if they don't then you're giving up your babies that you love and are attached to for really not a huge issue. I'd try moistening the dry food, mixing it with canned or trying semi-moist 'pouch food'.
