Welcome to the joys of NJ herp laws. They are very confusing, and you get different responses depending on who you talk to a FG&W.

I go by the official written herp laws which state:
Please keep in mind that the collection of any nongame species from the wild is illegal. This includes all nongame amphibians, reptiles, birds and mammals.
