help me understand the new law

woolleyfooley Mar 31, 2012 03:34 AM

So i know a new law has been passed but i havent been following the information too closely. I noticed in the burm classifieds there are only 7 ads which is when i remembered about the law. So what i want to know is, is it illegal to purchase burms at all now, or just having them shipped to you? I live in ny as well. I know in nj they sell burms at some of the exotic breeders/pet stores near me. So how can i LEGALLY obtain a new burm? If i purchased one in nj would it be illegal to bring it home across the nj/ny border? Im interested in purchasing a new burm so any help you can give me with information of how or even if i can legally obtain this species since the law passed would be greatly appreciated. Thanks in advance everyone.

Can't cross a state line with the prohibited species absent a permit from U.S.F.W. period...

In a nutshell, it is federally legal to do the following:
- Own a burmese
- Breed burmese
- Buy burmese
- Sell burmese

It is illegal to cross a state line with any living form of burmese (or yellow anaconda or af rocks) for any purpose without a permit issued.

You do need to check state, county and city/town laws first as well.

So I know this form is mainly for burms, but I have a question regarding this issue only it is for the yellow anacondas.
I am wondering if you can breed/sell baby yellow anacondas within your state (breeders) without needing a permit. Or did the new law make it required to obtain a permit to not only transport but to also breed and sell within state? I live in California and know it’s not legal to cross lines but want to be sure it’s not needed for a breeding permit also.

Thank you
Anthony

All species outlined by the addition to the lacey act (burms, yellow anacondas, both af rocks) are banned from interstate travel.

Intrastate (within your state) is governed by your local laws. If your state does not have a law against any of these species, check your county (or the county you are selling to). If you come up clear there, check your city.

As long as it is legal in your city, county and state, you may do it.
